Representative Matters

  • Played a part in the successful defense of a group of former co-workers who won a $216 million jackpot in New Jersey’s Mega Millions lottery contest. When the plaintiffs purchased the winning ticket and received their winnings, New Jersey law exempted lottery winnings from state income tax, however months later the State changed the rules and attempted to retroactively tax lottery winnings. The Tax Court granted partial summary judgment in favor of plaintiffs, holding that the State had failed to turn “square corners” in dealing with the plaintiffs.
  • Played a supporting role in an Appellate Division victory for a leading real estate developer, paving the way for the developer to advance a major project to clean up and develop a former industrial factory site in central NJ
  • Representing an employer whose former employee had pirated customers and misappropriated confidential information, Mr. Gladis successfully moved to dismiss the employee’s antitrust counterclaim, successfully moved for summary judgment on the employee’s tortious interference and unfair competition counterclaims, and successfully opposed multiple motions for summary judgment seeking to dismiss the employer’s claims for breach of loyalty, misappropriation of confidential information, and breach of contract claims, leading to a favorable settlement
  • Successfully briefed opposition to a motion for preliminary injunction in a class action seeking to halt a shareholder vote to approve a merger of publicly held companies
  • Played a key role in obtaining injunctive relief preventing the freeze-out and expulsion of a physician from the medical practice in which he was a partner, leading to a favorable settlement
  • Successfully briefed a dispositive legal issue of first impression in a commercial landlord-tenant action involving over $3 million in unpaid rent, establishing the tenant’s guarantor’s liability
  • Drafted an amicus brief regarding the Supreme Court’s authority to regulate real estate licensees involved in transactions in their personal capacities, whose reasoning the Supreme Court substantially adopted in Zaman v. Felton
